1. Eligibility

You must be at least 13 years old to use the Service. By using Around, you represent and warrant that:

  • You are at least 13 years old.
  • You have the legal capacity to enter into a binding agreement.
  • You will comply with all applicable laws and regulations.

We may suspend or terminate accounts that violate these requirements.

2. Nature of the Service

Around is a social platform that enables users to:

  • Share location and availability information,
  • Discover friends and events,
  • Communicate and coordinate meetups.

Around does not arrange, supervise, or control in-person interactions between users. We are not responsible for user conduct online or offline.

You acknowledge that:

  • Any in-person meeting is at your own risk.
  • We do not perform background checks.
  • We do not guarantee the accuracy of user profiles or content.

3. User Accounts

To use certain features, you must create an account.

You agree to:

  • Provide accurate and complete information.
  • Maintain the confidentiality of your login credentials.
  • Immediately notify us of unauthorized access.

You are responsible for all activity under your account.

We reserve the right to suspend or terminate accounts at our sole discretion.

4. User Conduct

You agree not to:

  • Harass, threaten, stalk, or harm other users.
  • Impersonate another person.
  • Post unlawful, defamatory, obscene, or abusive content.
  • Use the Service for illegal activity.
  • Attempt to access other users' private data.
  • Reverse engineer, scrape, or interfere with the Service.
  • Use the Service to advertise or solicit without permission.

We may remove content or terminate accounts without notice.

5. Location Sharing & Safety Disclaimer

Around allows users to share real-time or temporary location information.

By using these features, you understand and agree:

  • You control when and with whom you share your location.
  • You assume all risks associated with sharing your location.
  • Around is not responsible for any harm arising from location sharing or in-person interactions.

We strongly encourage users to exercise caution when meeting others.

6. User Content

You retain ownership of content you post ("User Content"), including:

  • Photos
  • Messages
  • Event details
  • Status updates
  • Location metadata

By posting content, you grant Around a worldwide, non-exclusive, royalty-free, transferable license to:

  • Host
  • Store
  • Reproduce
  • Display
  • Modify (for technical formatting)
  • Distribute

This license is solely for operating and improving the Service.

You represent and warrant that:

  • You own or have rights to your content.
  • Your content does not infringe any third party rights.

7. Content Moderation

We reserve the right, but are not obligated, to:

  • Monitor user content,
  • Remove content,
  • Suspend accounts,
  • Report unlawful activity.

We are not liable for user-generated content.

8. Intellectual Property

All Service content, design, trademarks, logos, software, and technology (excluding User Content) are owned by Around or its licensors.

You may not:

  • Copy,
  • Modify,
  • Distribute,
  • Reverse engineer,
  • Create derivative works

without prior written permission.

9. Prohibited Uses

You may not:

  • Attempt to hack or exploit vulnerabilities.
  • Use automated systems (bots, scrapers).
  • Interfere with platform security.
  • Access the Service through unauthorized means.
  • Use Around to build a competing service.

Violation may result in termination and legal action.

10. Third-Party Services

The Service may integrate third-party services (e.g., maps, messaging infrastructure, analytics, push notifications).

We are not responsible for third-party services or their terms.

Your use of those services is governed by their policies.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."

We disclaim all warranties, express or implied, including:

  • Merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy or reliability

We do not guarantee:

  • Continuous availability,
  • Error-free operation,
  • That users will behave safely or lawfully.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

Around and its founder, officers, employees, contractors, and affiliates shall not be liable for:

  • Indirect,
  • Incidental,
  • Special,
  • Consequential,
  • Punitive damages,

including but not limited to:

  • Personal injury,
  • Loss of data,
  • Lost profits,
  • Emotional distress,
  • Harm resulting from user interactions.

Our total liability for any claim shall not exceed:

The greater of $100 or the amount you paid us in the past 12 months.

13. Indemnification

You agree to indemnify and hold harmless Around and its founder from any claims, damages, liabilities, and expenses (including attorneys' fees) arising from:

  • Your use of the Service,
  • Your violation of these Terms,
  • Your content,
  • Your interactions with other users.

14. Termination

We may suspend or terminate your account at any time, with or without notice.

Upon termination:

  • Your right to use the Service ends.
  • Certain provisions (liability, indemnification, IP, arbitration) survive.

15. Arbitration & Dispute Resolution

Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration in California, under the rules of the American Arbitration Association.

You waive the right to:

  • Jury trial
  • Class action participation

16. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

17. Changes to Terms

We may modify these Terms at any time.

We will update the "Last Updated" date.

Continued use after changes constitutes acceptance.
